Home care agency license in Alaska

Non-medical home care is not state-licensed in Alaska — but the lanes around it are regulated, and the skilled door is a different license.

ItemAlaska
License / registrationNo licence for private-pay non-medical home care — Medicaid personal care is a provider CERTIFICATION, not a licence: Personal Care Services provider certification under 7 AAC 125.060 (and Community First Choice under 7 AAC 127.050); skilled lane: Home Health Agency licence under AS 47.32 / 7 AAC 12
Issued byAlaska Department of Health, Health Facility Licensing and Certification (HFLC) for home health agencies; Senior and Disabilities Services (SDS) for Personal Care Services / Community First Choice provider certification — official page
Application / initial feeNot published — No fee published for a private-pay non-medical agency (no licence) or on the SDS Personal Care Services certification materials reviewed. Do NOT apply the home health figures to non-medical care: the HHA provisional licence fee on the official HFLC page is tiered by full-time employees — $1,000 (5 or fewer FTEs), $1,500 (6-15), $2,000 (16-50), $3,000 (51+), plus $500 per branch/subunit.
RenewalNot applicable for non-medical care. HHA biennial renewal (due before 1 April of even-numbered years on the HFLC page) is $2,000 / $3,000 / $4,000 / $6,000 by the same FTE tiers, plus $1,000 per branch/subunit; relocation $150, miscellaneous modification $250.
Surety bondNo state bond minimum found in the published rules
Liability insuranceState sets no minimum for non-medical agencies in the sources reviewed. HHA licensure under 7 AAC 12 imposes its own facility standards, separate from personal care certification.
TimelineNot published
AdministratorFor Medicaid Personal Care Services the agency must employ an administrator who has attended the mandatory SDS division orientation (7 AAC 125.150(d)-(e)) and employ a supervising registered nurse to perform specified duties every 6 months, or every 12 months where a waiver is in effect (7 AAC 125.170(a)(2)). For a licensed HHA, 7 AAC 12.510 requires an administrator with education, experience and knowledge related to home health and at least 1 year of overall administrative experience in home health care or a related program, plus a physician or RN as director of clinical services (7 AAC 12.516). No administrator rule applies to a purely private-pay non-medical agency.
State extrasCentralised criminal history / registry checks for staff of licensed and certified providers, SDS administrator orientation time, and RN supervision time for PCS agencies are the real recurring costs; HHA lane adds the tiered licence fees and $500-$1,000 per branch/subunit.

Personal Care Services certification covers personal care in the recipient's residence under an approved service plan (7 AAC 125.010(b), 125.050(a)); it is not a general business licence and does not authorise skilled nursing/therapy, which requires the HHA licence. Criminal history checks under AS 47.05.300-390 apply to licensed entities including home health agencies (AS 47.32.010(b)(7)).

The skilled door in Alaska

Home health agencies are listed entities under AS 47.32.010(b)(7) and may not operate without a licence (AS 47.32.020); licensure is through HFLC under 7 AAC 12 with the tiered provisional/renewal fees above, an electronic policies-and-procedures submission and an onsite inspection. Federal certification is additional and optional ('may also be eligible').

Gate on record: Con

CON was NOT repealed — verify any claim otherwise. Alaska's Certificate of Need Program, AS 18.07, remains in the 2025 Alaska Statutes (Ch. 18.07, §§18.07.021 administration, 18.07.031 CON required, 18.07.035 application and fees, 18.07.041/043 standards of review). HB 77 in the 32nd Legislature was a bill 'repealing the certificate of need program' — a proposal, not an enactment. As codified, §18.07.031(a) requires a CON only for an expenditure of $1,000,000 or more for construction of a health care facility, alteration of bed capacity, or addition of a category of health services, plus any conversion of a building to a nursing home — so a typical asset-light home care / home health start-up below the $1M threshold does not trigger CON, but the program itself is alive and Alaska was reported in October 2026 as among states considering CON repeal for federal rural-health funds, i.e. still to repeal, not repealed.

Medicaid in Alaska: a second gate

Certify as a Personal Care Services provider with Senior and Disabilities Services under 7 AAC 125.060, or as a Community First Choice personal care provider under 7 AAC 127.050, signing the SDS Provider Assurances (compliance with 7 AAC 125.010-125.199 and the PCS Conditions of Participation), then enrol with Alaska Medicaid. HHA licensure is not the Medicaid personal care door — certification is.

EVV required for Medicaid personal care / home health visits under the federal Cures Act; Alaska is a hybrid model with Therap as aggregator in national EVV listings.
