He-P 822 covers agencies providing personal care services or homemaker services through employees. It excludes facilities already listed in RSA 151:2, agencies certified as Other Qualified Agencies under RSA 161-H / He-P 601, entities licensed under He-P 809, meal-only providers, and individuals providing care by direct agreement who register individually under He-P 820. Homemaker services (He-P 809 definition, mirrored in He-P 822) include laundry, house cleaning, cooking, transporting to/from appointments, shopping, companion services and medication reminders, and do not routinely involve hands-on contact beyond safety.

The skilled door in New Hampshire

Nursing, home health aide and therapeutic services (PT/OT/speech, medical social work, nutrition) require the Home Health Care Provider licence under He-P 809, also $250/year for agencies under RSA 151:5 XI(b). An entity licensed under He-P 809 is exempt from He-P 822, so a skilled agency can deliver personal care/homemaker under the 809 licence.

Medicaid in New Hampshire: a second gate

Medicaid home and community-based services (including Choices for Independence) are delivered either by a licensed HCSPA/HHCP or by an agency certified by DHHS as an Other Qualified Agency under RSA 161-H and He-P 601 — that certification is an alternative to He-P 822 for Medicaid personal care.

EVV required for Medicaid personal care / home health visits under the federal Cures Act; New Hampshire operates an open model (AuthentiCare aggregator in national EVV listings).
